 Criminal Prosecutions

Pursuant to Idaho Code 31-227, the primary duty of enforcing all the penal provisions of any and all statutes of the state is vested in the sheriff and the prosecuting attorney of each of the several counties. The County Prosecuting Attorney’s office prosecutes felony and misdemeanor crimes. The office also prosecutes juvenile delinquency and infraction cases.

Felony Prosecutions

Felony criminal statutes are found throughout the Idaho Code. However, they are primarily found in Title 18 (general criminal laws), Title 37, Chapter 27 (drug laws), and Title 49 (traffic). You can search for Idaho criminal codes at the State of Idaho’s Statutes and Constitution web site.

Misdemeanor Prosecutions

Misdemeanor criminal statutes are found throughout the Idaho Code. They are primarily found in Title 18 (general criminal laws), Title 37, Chapter 27 (drug laws), and Title 49 (traffic). You can search for Idaho criminal statutes at the State of Idaho’s Statutes and Constitution web site. County ordinances can also make violations misdemeanors.

Juvenile Prosecutions

Court rules governing juvenile proceedings are adopted by the Idaho Supreme Court and are located in Idaho Juvenile Rules.
